Can I go to jail for contempt for failure to pay child support?

  • Can I go to jail for contempt for failure to pay child support?

I have been called to court later this month for back child support. I recently sold a second car I owned and I am going to give ALL of the money to the AG. It will put me about 7 months ahead on child support. I have been behind on and off.

It is imperative that even during your leanest earning months you make at least a partial payment towards your ongoing child support obligation. The most difficult case to defend both for you and your lawyer is a monthly payment of $0.00. This is especially true if you paid other personal or business related bills. It makes it look like like you put your child support obligation dead last on your list of priorities. Your defense is likely to be more credible if you can say that even even when money was tight, I made the best effort I could.
